By accessing or using Ghost CRM, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These terms constitute a legally binding agreement between you and Ghost CRM Inc.
You must be at least 16 years old to use our services. By using Ghost CRM, you represent that you have the legal capacity to enter into this agreement.
Ghost CRM provides a cloud-based customer relationship management platform with features including lead management, opportunity tracking, task management, AI-powered insights, and integrations with third-party services.
We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted access. We may suspend service for maintenance, updates, or emergencies with reasonable notice when possible.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will provide notice of material changes when feasible.
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breaches.
We may suspend or terminate your account for violations of these terms, non-payment, or other legitimate reasons with appropriate notice.
You agree to pay all applicable fees for your selected plan. Fees are billed in advance on a monthly or annual basis, depending on your chosen billing cycle.
We accept major credit cards and ACH transfers. You authorize us to charge your payment method for all fees incurred.
We offer a 14-day money-back guarantee for new subscriptions. Refunds beyond this period are at our discretion.
We may change our pricing with 30 days' notice. Price changes will not affect your current billing cycle.
Late payments may result in service suspension. A late fee may be charged for overdue accounts.
You retain all rights to data you submit to Ghost CRM. We act as a data processor and will not access, use, or share your data except as necessary to provide services or as required by law.
We implement industry-standard security measures including encryption, access controls, and regular security audits. See our Security page for details.
We perform regular backups of your data. However, you are responsible for maintaining your own backup copies.
You may export your data at any time. Upon account termination, data is retained for 90 days before permanent deletion.
You may not use Ghost CRM for illegal activities, spamming, distributing malware, infringing intellectual property rights, or harassing others.
You are responsible for all content you upload or transmit through our services. Content must comply with applicable laws and regulations.
You may not attempt to gain unauthorized access, interfere with service operation, or circumvent security measures.
You agree to use our services fairly and not to abuse API rate limits or consume excessive resources.
Ghost CRM, including all software, designs, trademarks, and content, is owned by Ghost CRM Inc. and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use our services in accordance with these terms.
You may not copy, modify, reverse engineer, or create derivative works from our services without written permission.
Any feedback or suggestions you provide may be used by us without obligation to you.
Ghost CRM may integrate with third-party services. Your use of third-party services is subject to their own terms and privacy policies.
We do not endorse or assume responsibility for third-party services or content.
Ghost CRM is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that our services will be error-free, secure, or uninterrupted. You use our services at your own risk.
To the maximum extent permitted by law, Ghost CRM Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.
You agree to indemnify and hold harmless Ghost CRM Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
We may terminate or suspend your account immediately for violations of these terms, non-payment, or other legitimate reasons.
Upon termination, your right to use our services ceases immediately. Data may be retained for 90 days before permanent deletion.
These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any disputes shall be resolved through binding arbitration in San Francisco, California, except for claims that may be brought in small claims court.
You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.
These terms constitute the entire agreement between you and Ghost CRM Inc. regarding our services.
If any provision is found unenforceable, the remaining provisions will continue in full force.
Our failure to enforce any provision does not constitute a waiver of that provision.
You may not assign these terms without our written consent. We may assign these terms without restriction.
